Terms of Service

1. Acceptance of Terms

By downloading, installing, or using On Pace For (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legal agreement between you and Tim Hibbard ("we," "us," or "our"), the developer of On Pace For (Bundle ID: com.timhibbard.onpacefor).

2. Description of Service

On Pace For is an iOS health and fitness tracking application that:

• Integrates with Apple HealthKit to track physical activity
• Provides activity projections and goal tracking
• Offers premium features through subscription
• Helps users monitor and forecast their fitness progress

3. Eligibility

You must be at least 13 years old to use the App. By using the App, you represent that you meet this age requirement. If you are between 13 and 18 years old, you must have parental or guardian consent to use the App.

4. Subscription Terms

4.1 Subscription Plans

On Pace For offers the following subscription plans:

• Monthly Subscription: $0.99 per month
• Annual Subscription: $9.99 per year

Both plans include a 14-day free trial for new subscribers.

4.2 Premium Features

Subscription provides access to:

• Advanced analytics and detailed insights
• Unlimited custom timelines
• Smart goal recommendations
• Data export functionality
• Workout intelligence features

4.3 Free Trial

New users are eligible for a 14-day free trial. You will not be charged during the trial period. Your subscription will automatically begin after the trial ends unless you cancel before the trial period expires.

4.4 Billing and Renewal

• Subscriptions are billed through your Apple ID account
• Payment is charged at confirmation of purchase or after the free trial
• Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the current period ends
• Your account will be charged for renewal within 24 hours before the end of the current period
• Renewal charges are equal to the current subscription price

4.5 Managing Subscriptions

You can manage and cancel subscriptions through your Apple ID account settings:

1. Open the Settings app on your iOS device
2. Tap your name at the top
3. Tap "Subscriptions"
4. Select "On Pace For"
5. Choose "Cancel Subscription"

4.6 Cancellation Policy

• You may cancel your subscription at any time
• Cancellation takes effect at the end of the current billing period
• You will retain access to premium features until the end of the paid period
• No refunds are provided for partial subscription periods
• If you cancel during the free trial, you will not be charged

4.7 Price Changes

We reserve the right to change subscription prices. Price changes will take effect at the start of your next billing cycle. We will notify you in advance of any price increases.

5. Refund Policy

Refunds are processed through Apple according to Apple's refund policies. To request a refund:

• Visit reportaproblem.apple.com
• Sign in with your Apple ID
• Find the On Pace For charge and select "Report a Problem"

Refund requests are subject to Apple's discretion and policies.

6. User Responsibilities

You agree to:

• Provide accurate information when using the App
• Use the App only for lawful purposes
• Not attempt to reverse engineer, decompile, or hack the App
• Not share your Apple ID credentials with others
• Grant necessary permissions (HealthKit access) for the App to function

7. Health and Medical Disclaimer

IMPORTANT: On Pace For is for informational and motivational purposes only. It is NOT a medical device and should NOT be used for medical diagnosis or treatment.

• The App does not provide medical advice
• Consult a healthcare professional before starting any fitness program
• The App's projections and insights are estimates and may not be accurate
• We are not liable for any health consequences resulting from use of the App
• Do not rely solely on the App for health-related decisions

8. Data and Privacy

Your use of the App is also governed by our Privacy Policy. Key points:

• All health data is stored locally on your device
• We do not upload your health data to external servers
• You can revoke HealthKit permissions at any time

9. Intellectual Property

The App, including all content, features, and functionality, is owned by Tim Hibbard and protected by copyright, trademark, and other intellectual property laws. You may not:

• Copy, modify, or distribute the App or its content
• Reverse engineer or extract source code
• Remove copyright or proprietary notices
• Use the App's name or branding without permission

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• The App is provided "AS IS" without warranties of any kind
• We do not guarantee accuracy, reliability, or availability of the App
• We are not liable for any damages arising from use of the App
• Our total liability shall not exceed the amount you paid for the subscription in the past 12 months

11. Termination

We reserve the right to:

• Suspend or terminate your access to the App for violations of these Terms
• Discontinue the App or any features at any time
• Modify or update the App without notice

Upon termination, you must stop using the App and delete it from your device.

12. Third-Party Services

The App integrates with:

• Apple HealthKit: Subject to Apple's terms and policies
• Apple In-App Purchase: Subject to Apple's payment terms
• Firebase (Google): For analytics and crash reporting

Your use of these services is subject to their respective terms and conditions.

13. Changes to Terms

We may modify these Terms at any time. We will notify you of significant changes through the App or by updating the "Last Updated" date above. Your continued use of the App after changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the United States and the state where the developer resides, without regard to conflict of law principles. Any disputes shall be resolved in the courts of that jurisdiction.
